Individual sessions generally consist of processing past/present stressors and emotions, setting and working towards achievable goals, and reflecting on weekly situations to better understand where to implement therapeutic techniques.

Legal Notice

Confidentiality, Legal Involvement, and Records Request Policy

Our practice is committed to protecting client confidentiality and strictly complying with federal and New York State privacy laws governing mental health records, including HIPAA and New York Mental Hygiene Law §33.13.

Medical Record Requests

For the protection of client confidentiality, our practice does not accept medical record requests by telephone.

All requests must be submitted in writing and include one of the following:

  • A valid written authorization signed by the client permitting release of records; or
  • A court order signed by a judge requiring the release of records.

Requests without proper documentation will not be processed. Staff cannot confirm whether an individual is or was a client without proper written authorization.

Legal Proceedings and Court Involvement

Our clinicians provide therapeutic services only and do not participate in legal or forensic matters. We do not provide services related to litigation or court proceedings, including but not limited to:

  • Custody or divorce disputes
  • Eviction or housing proceedings
  • Disability or insurance claims
  • Legal evaluations or forensic assessments
  • Court testimony or expert witness services
  • Legal documentation or reports for court purposes

Clients who are currently involved in, or anticipate involvement in, legal matters where a therapist may be asked for records, reports, or testimony must disclose this prior to starting treatment. The clinician may determine that a referral to another provider is appropriate.

Voluntary Treatment Only

Our practice serves voluntary clients seeking therapeutic care. We do not provide court-ordered, mandated, or forensic services. Initiating treatment implies voluntary participation.

Therapy vs. Forensic Evaluation

Psychotherapy is intended to support personal growth and mental health treatment. It is not designed to provide objective evaluations or legal recommendations. Clients seeking documentation for legal purposes should consult a qualified forensic mental health professional.


Subpoenas and Legal Requests

If a clinician receives a subpoena or other legal request:

  • The request will be reviewed under HIPAA and NY Mental Hygiene Law
  • A valid client authorization or court order is required before any records may be released
  • The requesting party may be billed for administrative and professional fees associated with responding

Extra protective clause: We do not provide therapy with the expectation that it will be used in court, legal proceedings, or any litigation. Therapy sessions cannot and will not be used to support claims in custody disputes, evictions, or legal conflicts, and any legal party attempting to use therapy records will likely be denied.

Legal and Court-Related Fees

If a clinician is subpoenaed, required to provide records, or asked to participate in legal proceedings, the requesting party is responsible for all fees associated with:

  • Preparation and review of records
  • Consultation
  • Travel
  • Waiting time
  • Testimony

These services are billed at the clinician’s standard professional rate and must be paid in advance unless required by law.

Client Acknowledgment

By beginning treatment, clients acknowledge and understand:

  1. Our clinicians provide therapeutic services only.
  2. We do not participate in legal disputes and are not engaged for forensic purposes.
  3. Legal requests for records or testimony may be limited or declined in accordance with applicable privacy laws.
  4. Psychotherapy notes and private session reflections are protected and will not be released except with a client authorization or court order.
  5. Clients agree to disclose any ongoing or anticipated legal proceedings prior to starting treatment.

This acknowledgment is intended to protect the confidentiality of therapy and prevent misuse of therapy records in legal contexts.
